TERMS & CONDITIONS
The terms and conditions for use of this website are detailed below and should be read carefully. We may vary these terms from time to time and therefore you should check them before you make a new purchase.
This website is owned and operated by N.Cumberlidge (Jewellers) LTD. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.
To place an order on our website, you must be at least 18 years of age and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited under any law or regulation applicable to you.
PLACING AN ORDER
When placing an order, you agree that:
(i) you are responsible for reading the full item listing before making a commitment to buy it
(ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
(iii) you have read the Delivery & Returns Policy
Whilst we are under no obligation to accept your order, we would normally do so where:
(i) the product is available
(ii) the order reflects current pricing
(iii) your credit card/debit card payment is approved by your credit card/debit card company and
(iiii) your order passes our verification checks
Orders placed using a debit/credit card must be based within the United Kingdom. Unfortunately, we do not accept non-UK credit or debit cards.
We reserve the right to refuse any order.
DISPATCH & DELIVERIES
All orders received online are processed and, depending on stock availability, are dispatched as promptly as possible and normally delivered next working day, we cannot be held responsible for any delays once Royal Mail has your order.
Where any products have a longer delivery time, we will contact you by email to confirm the approximate date of dispatch.
Delivery times stated are subject to order approval.
In stock orders placed before 3pm will be dispatched the same day between Monday to Friday (excluding bank holidays). Orders placed after 3pm on Friday will be dispatched the following Monday (excluding bank holidays).
If the item you order needs to be ordered/made to your specification, delivery is approximately 4-6 weeks.
Deliveries are made by Royal Mail using a signed for service complete with tracking information. Once your order has been dispatched, you will receive a notification including relevant tracking details.

This refund policy only applies to products sold via the website, for our stores policy's please contact the store directly.
You may return or exchange item(s) (subject to exceptions as detailed below) if they are not to your satisfaction within 14 days of purchase and we will refund you the item purchase price, or send you an alternative item upon agreement.
To exercise your right to a refund or exchange you must notify us you wish to return the item(s) within 14 days of you receiving the items(s), you then have another 14 days to return the item(s) to us.
You have a duty to take reasonable care of the item(s) until you return them. The returned item(s) must be in their original condition, undamaged, unused, and in the original packaging with all labels & tags. The original packaging must be undamaged and unmarked. You must also return the sales receipt for the relevant product when returning the product to us.
Returns can be made in store or by post to N.Cumberlidge, 44 High Street, Prestatyn, Denbighshire, LL19 9BB. Please ensure the item(s) are securely packaged and are sent back to us using a trusted delivery service. We recommend that you send your return via a Royal Mail tracked & signed for service. We also recommended to obtain proof of posting and keep it safe. The cost of postage for returns shall be borne by the customer unless the item is incorrect or faulty.
We do not accept the following which are excluded from this returns policy:
Products that are damaged (in any way) or used;
Products that are returned without original package and/or original packaging is damaged;
Products that are made to order, made to measure, custom made, bespoke or personalized; or
Products that, for reasons of health and/or hygiene - we are unable to accept the return earrings.
Once the returned item(s) are received by us, we will refund the cost of the item(s) within 7 days of return.

YOU RIGHT TO CANCEL
For distance selling orders, when buying an item online, you are allowed to return an item if you simply change your mind. You have the right to cancel at any time from the moment you place your online order, and up to 14 days from the day you receive the goods. You then have a further 14 days from the date you notify us of your cancellation to return the goods. -There are exemptions to online cancellations/returns which include made to order/personalized goods. For full details, please refer to our returns policy.
CANCELLATION BY US
We reserve the right to cancel the contract between us if:-
(i) We have insufficient stock to deliver the goods you have ordered; or
(ii) We do not deliver to your area; or
(iii) One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
If we do cancel your order we will notify you by e-mail and will re-credit any sum deducted by us from your credit/debit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity we shall have no liability to you unless you send us a notice in accordance with the notification clause of these terms and conditions, informing us of the problem as soon as reasonably possible following delivery of the goods in question. We shall then refund all monies paid by the customer.
We will inform you as soon as possible if your order will take longer to reach you than 14 days. We will endeavor to meet estimated delivery dates.
If we notify you of a problem with the delivery date under this condition, our only obligation will be at your option to:-
(i)Make good any shortage or non-delivery;
(ii)Replace or repair any goods that are damaged or defective (providing such faults have not been caused by your misuse, negligent handling or improper care of the goods); or
(iii)Refund to you the amount paid by you for the goods in question in whatever way we choose.
Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expense (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause(s) above.
Notwithstanding the foregoing nothing in these terms and conditions is intended to limit any right you might have as a consumer under applicable local law or other statutory right that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

PRICING, AVAILABILITY & WEBSITE ERRORS
Whilst every effort has been made to ensure that the information contained on this website is accurate and up to date, we will not be held liable for any errors, omissions or price changes. In the event that we are out of stock of an item we will contact you by email or phone.
We endeavour to ensure that all pricing information on the Website is accurate, rarely an error may occur and goods may be mispriced. If a pricing error is discovered or an order is placed at the erroneous price we will, at our discretion, either: contact you and ask you whether you wish to cancel your order or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.

No permission is given by us in respect of the use of any such brand names, photographs, product names or titles or copyrights and such use may constitute an infringement of the owners’ rights.
Each and every transaction carried out is deemed to be completed within the United Kingdom and therefore shall be governed by and interpreted in accordance with English Law. The terms of this charter (and any dispute, controversy, proceedings or claims of whatever nature in relation to them) shall be governed and interpreted in accordance with English Law and the English Courts shall have exclusive jurisdiction in relation thereto.
We reserve the right to change the conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.
EVENTS BEYOND OUR CONTROL
We will not be in breach of this Agreement or otherwise liable for any delay in performance if to the extent that any delay or failure is due to circumstances beyond its reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
